TERMS

All puppies are sold with LIMITED REGISTRATION.  Full registration is available after certain conditions are met.

If the puppy is sold on a non-breeding contract, Buyer is required to have the puppy spayed/neutered between eight and twelve months of age unless a separate agreement is made between Buyer and Seller.  Seller reserves the right to withhold registration papers until a signed statement from Buyer's vet is received by Seller stating that the puppy has been altered.

If the puppy is sold on a show/breeding contract, registration papers will be sent but full registration will be not be granted until after the following have been requirements have been met:  PennHip has been performed with a rating of 50th percentile or better and/or OFA has been performed after twenty-four months of age with a rating of Fair, Good, or Excellent, elbows have been OFA certified as normal after twenty-four months of age,  and the puppy  is at least twenty-four months of age.  The puppy must also earn a title in conformation or be titled in a performance event sanctioned by AKC, UKC, or CKC (Canadian).  Canine Good Citizen (CGC) will not be accepted.  If the puppy is a proven working dog then a title may not be required per Seller's discretion.  If Seller decides no title is required, a separate contract stating this will be signed and mailed to Buyer.

Buyer has three days (excluding weekends and holidays) from the receipt of the puppy to have it examined by a veterinarian and provide Seller with the results.  If the puppy is found to be unhealthy, the Buyer may return the puppy for a full refund or a replacement puppy of equal value.  A signed diagnosis from the veterinarian stating that the puppy is unhealthy must be provided.  Puppy must be returned to Seller before a refund will be given.  Buyer is responsible for costs associated with returning the puppy and receiving the replacement puppy.  The buyer may choose keep the puppy and Seller will refund up to half of the purchase price of the puppy to cover the cost of veterinary care associated with the illness.  The Buyer is responsible for any costs over half the purchase price of the puppy.  A signed diagnosis from the veterinarian stating that the puppy is unhealthy must be provided.  Receipts must be provided before reimbursement will be given for veterinary fees.  No cash refunds will be given after three days.

HEALTH/GENETIC GUARANTEE

When Buyer receives the puppy, the puppy will have had the first vaccinations given unless Buyer requests no vaccinations.  The puppy will have been checked by a veterinarian and have been wormed if necessary unless Buyer requests no wormings.  Any medication prescribed for the puppy at this check-up will be provided to the Buyer at no cost to the Buyer.

If Buyer requests no vaccinations then Seller will not guarantee against any illness that could have been prevented with vaccinations.  If Buyer requests no wormings then Seller does not guarantee that the puppy does not have intestinal parasites.

The puppy is guaranteed to be suitable for the purpose for which the puppy was purchased.

Puppies sold on non-breeding contracts that are unable to live a normal pet life due to discomfort from a genetic condition will be replaced with a puppy of equal value.  A signed diagnosis by a veterinarian must be provided before a replacement puppy will be allowed.  If Buyer has allowed the puppy to breed then no guarantee will be honored.  Buyer is responsible for the costs associated with shipping the replacement puppy.  Seller reserves the right to require that the Buyer take the puppy to a different veterinarian of Seller's choice for a second opinion.  No puppy may be euthanized without Seller's consent unless a vet statement is signed stating that the humane euthanasia was the only option.  A copy of the statement must be sent to Seller.

Puppies sold on show/breeding contracts that can live a normal pet life but are unsuitable for breeding due to a genetic condition must be spayed/neutered.  A written diagnosis by a veterinarian must be provided before a replacement will be allowed.  Buyer is not required to return the puppy.  If Buyer chooses to keep the puppy, Seller will allow a new puppy of equal value at half price.  If Buyer chooses to return the puppy, a new puppy of equal value will be given.  Proof of altering must be received before a replacement will be allowed.  If Buyer has allowed the puppy to breed, then Buyer accepts the puppy to be in good health and no guarantee will be honored.  Buyer is responsible for the costs associated with returning the puppy and receiving the replacement puppy.  Seller reserves the right to require that the Buyer take the puppy to a different veterinarian of Seller's choice for a second opinion.    Seller will pay for the office visit and the tests to confirm the illness but additional tests and medications are the responsibility of the Buyer.  No puppy may be euthanized without Seller's consent unless a vet statement is signed stating that the humane euthanasia was the only option.  A copy of the statement must be sent to Seller.

Temperament is only guaranteed at Seller's discretion.  If the puppy has not been through an obedience class, temperament WILL NOT be guaranteed.

PAPERWORK/REGISTRATION

Puppies comes with either an AKC or UKC registration application unless puppy is dual registered whereas the Buyer will receive both an AKC and a UKC registration application, a copy of both parents' three generation pedigree, a copy of both parents' OFA certificate, pictures of each parent, pictures of the puppy, a copy of the veterinary receipt stating the puppy is healthy at time of exam, and the puppy's vaccination records.  Any medication that may have been prescribed by the veterinarian will also be provided at no cost to the Buyer.  Buyer has the right to name the puppy, however, the name Hart&Starr must be at the beginning of the name.

BUYER OBLIGATIONS

Must provide $300 deposit after confirmation of pregnancy and will be refunded if no puppy's are available. Buyer must provide the puppy an INDOOR environment.  No puppies from Hart&Starr Shepherds may be strictly outdoor pets.  Buyer agrees to provide quality food and fresh water for the puppy daily.  Buyer agrees to exercise the puppy regularly.  Buyer agrees to provide veterinary care.  Seller REQUIRES a basic, level one, obedience class by four to six months of age.  Great dogs don't just happen.  Their owners make them.  Early obedience and socializing is the best way to ensure a good, happy relationship with a puppy.  Buyer agrees to provide Seller with a current address and phone number for the life of the puppy.  UNDER NO CIRCUMSTANCES IS A HART N STARR PUPPY TO GO TO A SHELTER OR RESCUE!  If Buyer cannot keep the puppy, the puppy must be returned to the Seller unless a written agreement is signed by the Seller stating that the Buyer can sell the puppy to a third party.  If abuse/neglect is suspected the Seller reserves the right to order the puppy to be seen by a veterinarian of Seller's choice.  Seller will pay for the office visit and examination only.  Any medications, vaccinations, or other costs are the responsibility of the Buyer.  If abuse/neglect is confirmed, the Buyer relinquishes all rights to the puppy and the puppy automatically becomes the property of the Seller.  The Seller is under no obligation to pay the Buyer for the puppy should abuse or neglect be confirmed.  The Buyer will be required to sign ownership over to the Seller immediately including transferring the registration to Seller's name.  Buyer will be responsible for the fees associated with transferring registration to Seller's name.  Any offspring that the puppy currently has will also become Seller's property and must be returned with the puppy.  Buyer will be required to sign the litter registration and the puppy registration papers.  The Buyer will be responsible for all veterinary fees resulting from abuse/neglect of the puppy.  Buyer will also be responsible for the costs of shipping the puppy and any offspring back to Seller.

LEGAL

Buyer understands this is a legally binding contract and is under the jurisdiction of the State of Washington, the County of Snohomish, and the City of Tulalip.  All disputes will be resolved in the state of Washington in a court of Seller's choice.  Buyer has read the contract in its entirety and understands it fully.  Buyer agrees to the terms within this contract.
